Hello There You LLC ("Hello There You," "we," "us," or "our") welcomes you. We provide you access to our website located at https://hellothereyou.com/ (the "Site") subject to the following Terms of Use, which may be updated by us from time to time without notice to you. By accessing the Site, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Use and our Privacy Policy, which is hereby incorporated by reference (collectively, this "Agreement"). If you do not agree to any of these terms, then please do not use the Site.

In addition to the Site, Hello There You provides Customers access to photo booth and event services, subject to the terms and conditions of the applicable rental agreement between the Customer and Hello There You (the "Rental Agreement"). In the event of a conflict between the terms of this Agreement and the terms of the Rental Agreement, the Rental Agreement will control.

1. Use of Personal Information

Your use of the Site may involve the transmission to us of certain personal information. Our policies with respect to the collection and use of such personal information are governed according to our Privacy Policy, which is hereby incorporated by reference in its entirety. We reserve the right to update or change our Privacy Policy at any time. Use of the Site and acceptance of these Terms of Use also acts as an agreement to our Privacy Policy.

2. Services and Pricing

The materials appearing on Hello There You's website, including service descriptions, pricing, and availability, could include technical, typographical, or photographic errors. Hello There You does not warrant that any of the materials on its website are accurate, complete, or current. Hello There You may make changes to the materials contained on its website at any time without notice. Pricing and availability are subject to change and must be confirmed at the time of booking.

3. Community Guidelines

By accessing and/or using the Site, you hereby agree to comply with these community rules and that:

  • You will comply with all applicable laws in your use of the Site and will not use the Site for any unlawful purpose;
  • You will not access or use the Site to collect any market research for a competing business;
  • You will not upload, post, or transmit any content that infringes any copyright, trademark, or other proprietary rights of any person or entity;
  • You will not upload content that is threatening, defamatory, obscene, or invasive of another's privacy;
  • You will not impersonate any person or entity or falsely state your affiliation with a person or entity;

  • You will not take any action that imposes an unreasonable load on our technical infrastructure.

The Site contains materials, such as software, text, graphics, images, sound recordings, and audiovisual works provided by or on behalf of Hello There You (collectively referred to as the "Content"). The Content is protected under both United States and foreign laws. Unauthorized use of the Content may violate copyright, trademark, and other laws.

You have no rights in or to the Content, and you will not use the Content except as permitted under this Agreement. You must retain all copyright and other proprietary notices contained in the original Content on any copy you make of the Content. The use or posting of the Content on any other website or in a networked computer environment for any purpose is expressly prohibited.

The trademarks, service marks, and logos of Hello There You used and displayed on the Site are registered and unregistered trademarks or service marks of Hello There You. Nothing on the Site should be construed as granting any license or right to use the trademarks without our prior written permission.

5. User Content and Communications

By submitting any content to us, including photos from events, testimonials, or feedback, you grant us a royalty-free, non-exclusive, perpetual license to use, reproduce, modify, and distribute such content for marketing and promotional purposes. You represent that you have the right to grant such license and that your content does not violate any third party rights.

With respect to all communications you send to us, including feedback, questions, comments, and suggestions, we shall be free to use any ideas, concepts, or techniques contained in your communications for any purpose whatsoever.

6. Event Photos and Privacy

Photos and videos taken at events using our services may be used for promotional purposes unless otherwise specified in the Rental Agreement. Event hosts are responsible for obtaining necessary permissions from their guests. We will handle all personal data in accordance with our Privacy Policy and applicable data protection laws.

7. Warranties and Limitation of Liability

Important Notice

THE SITE AND THE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

IN NO EVENT SHALL HELLOTHEREYOU BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION RESULTING FROM THE USE OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Any direct damages that you may suffer as a result of your use of the Site shall be limited to one hundred dollars ($100), except as provided in any rental agreement between you and Hello There You.

8. External Sites

The Site may contain links to third-party websites. These links are provided solely as a convenience to you and not as an endorsement by us of the content on such sites. We are not responsible for the content of any linked sites and do not make any representations regarding the content or accuracy of materials on such sites.

9. Indemnification

You agree to defend, indemnify, and hold us and our officers, directors, employees, successors, licensees, and assigns harmless from and against any claims, actions, or demands, including reasonable legal and accounting fees, arising from: (i) your breach of this Agreement; (ii) your misuse of the Content or the Site; and/or (iii) your violation of any third-party right, including any copyright, trademark, property, or privacy right.

10. Governing Law

This Agreement is governed by the internal substantive laws of the State in which Hello There You operates, without respect to its conflict of laws provisions. Any disputes arising hereunder shall be resolved exclusively by state or federal courts located in our state of operation.

11. Termination

We reserve the right, in our sole discretion, to restrict, suspend, or terminate this Agreement and your access to all or any part of the Site, at any time and for any reason without prior notice or liability. We reserve the right to change, suspend, or discontinue all or any part of the Site at any time without prior notice or liability.

12. Miscellaneous

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to act on or enforce any provision of the Agreement shall not be construed as a waiver of that provision or any other provision in this Agreement.

This Agreement constitutes the entire Agreement between you and us with respect to the use of the Site, and supersedes all previous or contemporaneous agreements, whether written or oral, between the parties with respect to the subject matter.
